PRIVACY POLICY

1. General Provisions

1.1. This Personal Data Processing Policy (hereinafter referred to as the Policy) has been developed in accordance with the Constitution of the Republic of Uzbekistan, the Law of the Republic of Uzbekistan dated 02.07.2019 No. ZRU-547 "On Personal Data" (hereinafter referred to as the Law), as well as other regulatory legal acts of the Republic of Uzbekistan in the field of personal data protection.

1.2. This Policy defines the procedure for processing personal data and measures to ensure their security taken by KELYANMEDIA Limited Liability Company (hereinafter referred to as the Operator, the Company) in relation to visitors and users of the website https://kelyanmedia.uz/ (hereinafter referred to as the Site), as well as persons who have contacted the Operator by other means of communication: by telephone, via instant messengers, email or social networks.

1.3. The Operator sets as its most important goal and condition for the implementation of its activities the observance of human rights and freedoms when processing their personal data, including the protection of the rights to privacy, personal and family secrets.

1.4. Using the Website, as well as submitting data through feedback forms, applications, quote requests, newsletter subscription forms, or otherwise, constitutes the User's agreement to the terms of this Policy. If the User disagrees with the terms of this Policy, they must stop using the Website.

1.5. This Policy does not apply to the processing of personal data of the Operator's employees, for whom a separate internal policy applies.

1.6. Unrestricted access to the Policy is ensured by publishing it publicly on the Website.

2. Terms and definitions

2.1. Personal data – information recorded on electronic, paper and/or other tangible media that relates to a specific individual or makes it possible to identify him/her.

2.2. Processing of personal data is the implementation of one or a set of actions to collect, systematize, store, modify, supplement, use, provide, distribute, transfer, depersonalize, and destroy personal data, including through the use of automation tools.

2.3. Operator – KELYANMEDIA LLC, which independently organizes and carries out the processing of personal data, and determines the purposes of such processing.

2.4. User – any individual visiting the Site, using its functionality, or otherwise contacting the Operator.

2.5. The Website is a collection of information materials, computer programs, and databases available on the Internet at https://kelyanmedia.uz/.

2.6. Consent of the personal data subject is a voluntary, specific, informed and unambiguous expression of the will of the personal data subject, by which he/she permits the processing of his/her personal data.

2.7. Depersonalization of personal data – actions that make it impossible to determine the ownership of personal data by a specific subject without the use of additional information.

2.8. Destruction of personal data – actions as a result of which personal data are irrevocably destroyed with the impossibility of further restoration of their contents.

2.9. Cookies are small text files that are stored on the User's device when visiting the Site and are used for its proper operation and analytics.

2.10. Cross-border transfer of personal data – transfer of personal data to the territory of a foreign state to a foreign government body, a foreign individual or a foreign legal entity.

3. Principles of personal data processing

The Operator processes personal data based on the following principles:

  • the legality of the purposes and methods of processing personal data, good faith and fairness;
  • compliance of the purposes of processing personal data with the purposes previously determined and stated when collecting personal data;
  • compliance of the volume and nature of processed personal data, methods of processing personal data with the purposes of processing personal data;
  • the inadmissibility of combining databases containing personal data, the processing of which is carried out for purposes incompatible with each other;
  • ensuring the accuracy, sufficiency and relevance of personal data in relation to the purposes of processing;
  • storage of personal data in a form that allows identification of the subject of personal data for no longer than required by the purposes of processing, unless another period is established by law or agreement;
  • destruction or depersonalization of personal data upon achievement of the processing purposes or in the event of loss of the need to achieve them.

4. Categories and composition of personal data subject to processing

4.1. Data voluntarily provided by the User when filling out forms on the Website (application form, "Brief for cost calculation" form, subscription form, personal account) or when contacting us in any other way: name, telephone number, email address, company name, position, as well as other information that the User specifies in the free text field or attaches to the request.

4.2. Data collected automatically when visiting the Site: IP address, browser type and version, operating system, information about pages visited, time spent on the Site, referral source, as well as data from cookies and similar tracking technologies.

4.3. Data of applicants submitting resumes and responses to Operator vacancies: last name, first name, patronymic, contact information, information about education, qualifications and work experience, other data indicated by the applicant in the resume.

4.4. Details of the Operator's counterparties and their representatives required for the conclusion, execution, and maintenance of civil contracts: last name, first name, patronymic, position, contact information, payment and other details stipulated by the terms of the contract.

5. Purposes of personal data processing

The operator processes personal data for the following purposes:

  • processing of applications, briefs and requests from Users, provision of consultations and feedback;
  • preparation, conclusion and execution of contracts for the provision of Operator services: SEO and GEO promotion, contextual and targeted advertising, SMM, website and mobile application development, comprehensive internet marketing;
  • sending informational, advertising and news mailings, messages about new services and special offers;
  • analysis of the Site’s operation, improvement of its functionality, structure and content;
  • ensuring the security of the Site, identifying and preventing fraudulent and other illegal activities;
  • recruitment of personnel and formation of a personnel reserve in the presence of open vacancies;
  • fulfillment of obligations stipulated by the legislation of the Republic of Uzbekistan, including accounting and tax records.

6. Legal grounds for processing personal data

The processing of personal data is carried out on one or more of the following grounds:

  • consent of the subject of personal data to the processing of his personal data;
  • the need to execute an agreement to which the personal data subject is a party, or to take measures at his request before concluding such an agreement;
  • the need to fulfill the duties of the Operator established by the legislation of the Republic of Uzbekistan;
  • the need to protect the legitimate interests of the subject of personal data or another person;
  • the need to exercise the rights and legitimate interests of the Operator or to achieve socially significant goals, provided that this does not violate the rights and legitimate interests of the personal data subject;
  • cases where personal data is made publicly available by the subject himself or is obtained from publicly available sources.

7. Procedure, conditions and terms for processing and storing personal data

7.1. Consent to the processing of personal data is provided by the subject of personal data by checking the appropriate box on the form on the Website and clicking the submit button, or by another method provided by the functionality of the Website, as well as in written or electronic form upon conclusion of an agreement.

7.2. Personal data received through application forms and briefs are stored for no more than 5 (five) years from the User’s last request, unless a longer period is established by law.

7.3. Personal data processed in connection with the conclusion and execution of an agreement shall be stored for the term of the agreement and for 5 (five) years after its expiration, unless another period is established by the legislation of the Republic of Uzbekistan.

7.4. Applicant data is stored for 1 (one) year from the date of receipt of the resume, if the applicant is not hired, or for the duration of the employment relationship, if hired.

7.5. Upon achievement of the processing purposes, expiration of the storage period, or upon withdrawal of consent, personal data shall be subject to destruction or anonymization, unless otherwise provided by law.

7.6. The personal data subject has the right to revoke their consent at any time by sending a corresponding notification to the Operator's email address: kelyanmedia@gmail.com. The Operator will cease processing and destroy the personal data no later than one business day following the day of receipt of such notification, unless processing is necessary for other legal reasons.

8. Transfer of personal data to third parties

8.1. The Operator does not sell, exchange, or lease Users' personal data to third parties for purposes unrelated to the implementation of this Policy.

8.2. The operator has the right to transfer personal data to the following categories of recipients to the extent necessary for them to perform the relevant tasks:

  • providers of hosting, development and technical support services for the Site;
  • web analytics services and advertising platforms, including Google Analytics, Yandex.Metrica, Google Ads, Meta Ads and similar systems;
  • to telecom operators, mail and messenger services (including Telegram, WhatsApp, Instagram, Facebook) for the purpose of communication with the User;
  • email distribution services and CRM systems used to process requests and maintain a client base;
  • government agencies if there are legal grounds and in the manner established by the legislation of the Republic of Uzbekistan.

8.3. Service providers engaged by the Operator are granted access only to the volume of personal data that is necessary to provide the relevant services and are obliged to ensure the confidentiality of the data received.

9. Cross-border transfer of personal data

9.1. In connection with the use of certain services and messengers (Telegram, WhatsApp, Instagram, Facebook, Google Analytics and other similar systems), the servers of which may be located outside the Republic of Uzbekistan, the Operator may carry out cross-border transfer of personal data.

9.2. By accepting the terms of this Policy and submitting their data through the Site, the User consents to the cross-border transfer of their personal data for the specified purposes.

9.3. The Operator shall carry out cross-border transfer of personal data only to states that ensure adequate protection of the rights of personal data subjects, or in the presence of other legal grounds stipulated by the legislation of the Republic of Uzbekistan.

10. Cookies and analytics

10.1. The website uses cookies to ensure the proper functioning of its functionality, analyze traffic, and improve the user experience.

12. Measures to protect personal data

12.1. The operator shall take the necessary legal, organizational, and technical measures to protect personal data from unauthorized or accidental access, destruction, modification, blocking, copying, provision, distribution, as well as from other illegal actions of third parties.

12.2. Access to personal data is granted only to those employees and engaged persons of the Operator who need it to perform their work or contractual duties.

12.3. The Operator informs that no method of transmitting or storing information electronically is completely secure, and cannot guarantee the complete protection of the Site and data from all possible threats; however, it takes all reasonable measures to minimize such risks.

13. Processing of personal data of minors

The Operator's website and services are not intended for individuals under 18 years of age. The Operator does not knowingly collect personal data from such individuals. If the Operator becomes aware that personal data from a minor has been obtained without the consent of their parent or legal guardian, such data will be deleted.

14. Links to third-party resources

The Website may contain links to third-party websites and services not controlled by the Operator.
